Booking Terms & Conditions
Footbreaks Travel LLC dba Footbreaks is a small group tour operator specializing in unique meetup walks and hikes. The terms “we”, “us”, “our”, and “Footbreaks” refer to Footbreaks Travel LLC, a California limited liability company. The term “you”, “traveler”, “participant” or “guest” refers to the person making a booking with us and all members of their group.
Meetups
1. Payment
Full payment is required at the time of booking.
All payments are non-refundable.
Payment for Footbreaks meetups must be made in advance through our secure online system. We accept major credit cards (Visa, Mastercard, American Express, Discover) and debit cards. Additional digital wallet options (such as Apple Pay or Google Pay) may also be available through our payment processor, Stripe. Cash payments are not accepted.
2. Participant Cancellations
24 hours or more before the meetup:
You will receive a credit equal to your booking payment. This credit may be applied toward a future Footbreaks meetup within twelve (12) months of the original booking date. Credits are non-transferable to another individual.Less than 24 hours before the meetup:
No credit will be issued.No-shows (failure to attend without notice):
No credit will be issued.
3. Late Arrival & Partial Participation
Meetups begin promptly at the scheduled start time.
Participants who arrive late may join the group if logistics allow, but the meetup will not be delayed.
If you choose to join late, leave early, or participate in only a portion of the meetup, no refund or credit will be issued.
4. Cancellations by Footbreaks
If Footbreaks cancels a meetup due to safety, weather, or other unforeseen circumstances, you will receive a full refund of your booking payment.
Footbreaks will not be responsible for any incidental or consequential expenses incurred (including transportation, lodging, or meals).
5. Weather & Conditions
Meetups operate rain or shine, except in cases of extreme or unsafe conditions at the discretion of Footbreaks.
In such cases, participants will be offered either a credit for a future meetup or a full refund.
6. Minimum Participation
Footbreaks reserves the right to cancel a meetup if minimum participation requirements are not met, 3 participants.
In such cases, participants will receive a full refund or credit.
7. Substitution of Guide or Changes
Footbreaks may substitute guides or adjust the route if necessary due to safety, logistics, or operational reasons.
Such changes will not entitle participants to a refund or credit, provided the meetup proceeds.
8. Health & Fitness Acknowledgment
By booking, you confirm that you are in suitable health and physical condition to participate in the selected meetup.
Participants are responsible for bringing appropriate footwear, water, sun protection, and any personal medications needed.
9. Personal Belongings
Participants are solely responsible for their personal belongings.
Footbreaks is not liable for lost, stolen, or damaged personal property during meetups.
10. Code of Conduct
Participants must conduct themselves according to our Community Commitment.
Footbreaks reserves the right to remove anyone whose behavior is unsafe, disruptive, or offensive. No refunds or credits will be issued in such cases.
11. Acknowledgment of Waiver
Participation also requires signing the separate Footbreaks Waiver & Release of Liability.
By booking, you acknowledge that you have read and agreed to the waiver terms, which apply to all Footbreaks activities.
Completing the waiver is valid for 1 year and covers meetups you attend during that time frame.
12. Modification of Terms
Footbreaks reserves the right to update these Terms at any time.
Updated Terms will apply to all bookings made after the date of modification.
International Breaks
For select multi-day and international trips (“International Breaks”), Footbreaks Travel LLC (DBA “Footbreaks”) may partner with independent third-party travel companies to operate and deliver the trip experience. For the Costa Rica trip (October 8–12, 2026) and any similar International Breaks, Here & Now Travel (“Operator”) is the supplier and tour operator of record and is solely responsible for trip operations, fulfillment, and travel services. The term '“you”, “traveler”, “participant” or “guest” refers to the person making a booking and with all members of their group. Footbreaks role is limited to marketing, community building and social hosting only.
By reserving or participating in an International Break promoted by Footbreaks, you acknowledge and agree to the following:
1. Third Party Booking & Contractual Relationship
Footbreaks acts solely as a marketing affiliate and community host for International Breaks. Footbreaks is not a travel agency, tour operator, carrier, or provider of transportation, accommodations, or travel services.
All reservations are made directly with the Operator. Your booking creates a direct contractual relationship solely between you and the Operator. Footbreaks is not a party to that agreement and does not assume responsibility for the performance of travel services.
2. Payments, Refunds & Financial Responsibility
All payments are collected directly by the Operator. Footbreaks does not at any time hold, manage, process, or control participant funds for International Breaks.
Accordingly, Footbreaks:
cannot issue refunds or credits
cannot modify pricing or cancellation terms
has no authority over financial disputes
All payment matters, cancellations, credits, or refund requests must be handled directly with the Operator.
3. Operator Terms & Conditions Apply
Your participation is subject exclusively to the Operator’s Terms & Conditions, policies, and final itinerary, including those related to cancellations, health requirements, liability, and trip changes.
In the event of any conflict between:
Footbreaks marketing materials or communications, and
the Operator’s official documents or final itinerary
the Operator’s documents shall control.4. Hosting Role/ No Operational Control
4. Role of Host & Host Availability
Footbreaks may provide a representative (e.g., Kyle Albini) to attend the trip in a social, community-building “Host” capacity.
The Host:
does not manage logistics
does not supervise activities
does not act as a guide or operator
does not assume responsibility for safety or operations
Host attendance is not guaranteed.
If the Host is unable to attend due to illness, emergency, scheduling conflicts, or other unforeseen circumstances, the trip will proceed as scheduled under the Operator’s management.
The absence of a Host does not constitute a material or significant change and does not entitle participants to refunds, credits, or compensation.
5. Marketing Materials vs Actual Itinerary
Photos, descriptions, social media posts, emails, and website content provided by Footbreaks are for illustrative and promotional purposes only and are intended to convey the general style or “vibe” of the experience.
The Operator reserves the right to modify or substitute:
hotels
activities
routes
guides
schedules
transportation
or other trip elements
Footbreaks is not liable for discrepancies between marketing materials and the services actually provided by the Operator.
No specific experiences, outcomes, or satisfaction levels are guaranteed.
6. Travel Insurance
Participants are strongly encouraged, and may be required by the Operator, to purchase comprehensive travel insurance covering trip cancellation, interruption, medical expenses, evacuation, and repatriation.
Participants who decline travel insurance assume full financial responsibility for any losses or expenses.
Footbreaks shall not be responsible for any uninsured losses.
7. Assumption of Risk
You acknowledge that travel and outdoor activities involve inherent risks, including but not limited to:
illness or injury
accidents
terrain hazards
weather conditions
transportation risks
foreign medical systems
acts of third parties
unforeseen events
By participating, you voluntarily assume all risks associated with travel and participation in the International Break
8. Your Behavior
Each traveler in any trip planned by Footbreaks is expected to act responsibly and adhere to all behavior guidelines established by Footbreaks and our Suppliers. Footbreaks and all Suppliers reserve the right to remove you from any facility, hotel or resort property, trip location or means of transportation if your health or your conduct appears to endanger yourself or others, disrupts the general well-being of other individuals on any element of your trip, interferes with the operation or security of the places we visit, or constitutes a violation of our Traveler Community Commitment. In any such case, there will be no refund.
When you book with Footbreaks you accept responsibility for any damage or loss caused by you or your group. Full payment for any such damage or loss (reasonably estimated if not precisely known) must be paid directly at the time to the accommodation owner or manager or other Supplier. You must indemnify us for the full amount of any claim (also including legal costs) made against us. We are not responsible for any costs incurred concerning a guest removed from a trip, or any portion of a trip. You agree not to hold Footbreaks or any of its related entities liable for any actions taken under these Terms and Conditions. Baggage and personal effects are at all times the sole responsibility of the traveler.
You acknowledge and agree to follow and abide by any and all laws and regulations of any state and/or country you enter while participating in the trip. While all local and national laws and regulations are important to follow, we strictly encourage you to be informed concerning the use and/or possession of drugs in particular. There will be no tolerance for any use or possession of any drug and your failure to strictly comply with this requirement will result in a breach of these Terms and Conditions and may prevent you from your continued participation. We require responsible alcohol consumption for your safety and for those around you. If you are asked to leave a trip for inappropriate behavior, violence, or any other disruptive action, you will not be refunded.
In accordance with the foregoing, you agree to travel in accordance with our Traveler Community Commitment(incorporated herein by reference).
9. Authority on Trip
Each trip is led by a Local Guide. The Local Guide will have full authority on the trip. If you fail to comply with a decision made by the Local Guide or interfere with the well-being, mobility or safety of the group or any individual traveler or staff member participating in the trip, the Local Guide may direct you to leave the trip immediately, with no right of refund in whole or in part. If a traveler has a complaint about anything during their trip, traveler must first inform their Local Guide r so that the issue may be resolved locally on the trip. Any further complaints must first be put in writing and are subject to the Claims section below.
10. Limitation of Liability & Indemnification
Footbreaks is not responsible for the acts, omissions, errors, representations, warranties, breaches, or negligence of the Operator or any third-party suppliers.
To the fullest extent permitted by law, you agree to release, defend, indemnify, and hold harmless Footbreaks Travel LLC, its owners, officers, employees, contractors, and representatives from any and all claims, damages, liabilities, losses, or expenses (including attorneys’ fees) arising out of or related to:
your participation
injury or illness
property loss
dissatisfaction with services
or the acts of the Operator or third parties
9. Force Majeure
Footbreaks shall not be liable for delays, changes, interruptions, or cancellations resulting from causes beyond its reasonable control, including but not limited to:
natural disasters
severe weather
government actions
pandemics
civil unrest
strikes
transportation disruptions
or other force majeure events
10. Photographic/ Video Likeness
Traveler hereby gives consent and grants to Footbreaks a royalty-free, perpetual, and irrevocable license to publish any testimonials, reviews, photographs and/or videos of the trip or traveler in any form of media without obtaining further consent and without compensation, solely for the purposes of marketing our trips. Each traveler releases Footbreaks and its Representatives from any liability in connection with any use of such forms of media.
11. Class Action Waiver/ Limitation of Damage/ Notice of Claim
You agree that you will only bring claims against Footbreaks in your individual capacity and not as a plaintiff or class member in any purported class action or representative proceeding. Footbreaks shall not in any case be liable for other than compensatory damages, and your payment of a deposit on a trip means that you agree to these conditions of sale and expressly waive any right to punitive damages. You understand and agree that no claims will be considered and that you will not bring suit or claims against Footbreaks unless you have first provided a written notice of claim to Footbreaks within 30 days after the trip or cancellation of the trip, further provided that you agree to file suit within one (1) year of the incident and you acknowledge that this expressly limits the applicable statute of limitations to one (1) year. Any claims not submitted and received within this time shall be deemed irrevocably waived and barred. Notwithstanding the foregoing, in no event shall Footbreaks’ liability to you (or any member of your traveling party, or your/their heirs, successors and assigns), from any cause of action (whether in contract, tort, indemnity, equity, or otherwise), exceed the amounts paid to Footbreaks for the services Footbreaks performed and provided to you in connection with this Agreement, and this is your sole and exclusive remedy for a breach of this Agreement by Footbreaks.
12. Governing Law/ Arbitration/ Jury of Waiver
These Terms and Conditions and all attachments hereto and the rights of the parties hereunder shall be governed by and construed in accordance with the laws of the State of California exclusive of conflict or choice of law rules. Traveler agrees that any dispute concerning, relating or referring to this contract or any literature concerning the trip, or the trip itself, shall be resolved exclusively by binding arbitration in the State of California according to the then existing rules of the American Arbitration Association in the United States of America. Such proceedings will be governed by and in accordance with substantive United States of America law. If the foregoing arbitration provision is ruled invalid, then any claims shall be brought in a court of competent jurisdiction located in the State of California. You agree that you will only bring claims against Footbreaks in your individual capacity and not as a plaintiff or class member in any purported class action or representative proceeding. Footbreaks shall not in any case be liable for other than compensatory damages, and your payment of a deposit on a trip means that you agree to these conditions of sale and expressly waive any right to punitive damages
